Work Trial Agreement

We are excited to have you come checkout of what we do and work alongside us for a project. Work trials give you a chance to demonstrate your skills and suitability to Home Organize.
Throughout this agreement, the terms “we,” “us” and “our” refer to Leah Morris, Mindfully Minimized and; the terms "I" and "you" and "your" refer to the Freelancer/Independent Contractor/Work Trial Individual/Assistant. The term “Client” refers to the Client/Customer of the home organizing session. We offer you the ability to do home organizing alongside Mindfully Minimized conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein.
Independent Contractor shall not work with, consult, or conduct such other business activity with Clients of Mindfully Minimized LLC. This non-compete agreement shall extend to all current Clients of Mindfully Minimized LLC and shall be in full force and effect for 5 years, commencing with the date of last Independent Contracted job with Mindfully Minimized LLC.
This agreement shall be binding upon and the benefits of the parties, their successors, assigns, and personal representatives.
Background:
I have never been convicted of a felony or incarcerated in connection with a felony. Your drivers license has never been suspended.
Process Ownership
Regarding the purging, sorting, and organizing of items, the Client maintains process ownership. Mindfully Minimized LLC recognizes items as the sole property of the Client, and though efforts will be made to help purge when needed, it is hereby stated that the final decision on such matters belongs to the Client. I will determine where discarded items are taken unless the Client specify a particular donation location at the time of service. Furthermore, We must be told prior to removing your donated items if the Client would like a receipt from the donation center.
Confidentiality
All information seen, heard, or discussed with the client will be held in the strictest confidence. All client information is confidential, and we only use proprietary information with the permission of each client. We maintain the highest standards of confidentiality and respect for our Clients, their possessions and their homes. You acknowledge that you may be furnished or may otherwise receive or have access to information which relates to the Client’s past, present r future products, vendor list, creative work, marketing strategies, pending projects and proposals, and other proprietary information. You agree to preserve and protect the confidentiality of the personal and Proprietary Information and all the physical forms thereof, whether disclosed to Home Organizer before this agreement is signed or afterwards. In additional, you shall not disclose or disseminate the Proprietary Information to any third party and shall not pursue the Proprietary Information for your own benefit or the benefit of any third party. You shall be prohibited from discussing the Client or the Work with a representative of the press, media, either directly or indirectly.
The client recognizes that entering into this contract with Mindfully Minimized LLC means that an Organizer may be in contact with personal items and information. The organizer agrees not to divulge any of this information and to maintain the highest standards of confidentiality and respect for the Client’s possessions and home.

Ethics
Mindfully Minimized LLC follows the written Code of Ethics, provided by the National Association of Professional Organizers (NAPO). You agree to work under these codes of Ethics as well. You agree you will use reasonable care, lead with respect, and be judgment free.
Photo Release
Client releases all rights to before and after photos, to be used in Mindfully Minimized LLC publications, including but not limited to the website and pamphlets. Client agrees that photos may also be used for Mindfully Minimized LLC publications/website, provided that Client’s name is not linked to the photos in any way.

Liability Release
Everyone on the Mindfully Minimized LLC team goes to great lengths to treat Clients and their belongings with respect, care, and delicacy. That said, it is our policy to have every client and independent contractor agree to a liability waiver in the event of an accident. Thank you for understanding this is necessary to protect our business.
“I hereby acknowledge I understand there may be risks involved in moving furniture and accessories as part of the organizational services I have agreed to do with Mindfully Minimized LLC. I hereby accept all risk,and waive and all monetary claims for damage or injury to myself or my accessories, whether and assume all legal and financial responsibility myself for such.
I shall not now, nor in the future, make any claim against Leah Morris with Mindfully Minimized LLC or any of her employees, contractors, subcontractors, or assistants for any injury to myself due to time on the job.
I understand I am responsibility for items touched and organized in the Clients home.
I further agree to indemnify and hold harmless Leah Morris with Mindfully Minimized LLC or any of her employees, contractors, subcontractors, or assistants from liability for the injury or death of any person(s) and damage to property that may result from any negligent or intentional act or omission by Mindfully Minimized LLC as part of the organizational services I have contracted to do.”
The Client has chosen Mindfully Minimized to support them through the organization process and we are committed to make the experience superb for them

COVID-19 Agreement and Certification
Mindfully Minimized, LLC requires clients, subcontractors, assistants, and employees to take proper precautions as outlined by the Centers for Disease Control (CDC) when working together.
If you or a member of your household are not feeling well near the time of your scheduled appointment, we ask that you notify us to reschedule. Mindfully Minimized will do the same if an employee is not feeling well.
Each person present during an appointment individually acknowledges that the novel coronavirus (COVID-19) represents a serious health threat to persons exposed to it, and that all persons present during this visit are relying on the truthfulness and accuracy of the certifications made herein.
Each person present during this visit individually certifies that to the best of their knowledge, information, and belief, neither they nor a member of their household with whom they live:
1. Has been diagnosed (tested positive) with COVID-19.
2. Has a test pending for COVID-19.
3. Is under quarantine directed by a healthcare provider due to COVID-19 concerns.
• I understand that close contact with people increases the risk of infection from COVID-19. By signing this form, I acknowledge that I am aware of the risks involved.
• I agree to immediately notify Mindfully Minimized in the event that I, a member of my household, or visitors to my household, exhibit symptoms or tests positive for COVID-19 within 10 days following an appointment. Likewise, Mindfully Minimized will immediately notify you if an employee that has worked with you develops symptoms or tests positive for COVID-19 within 10 days following an appointment.
A signed contract & Covid-19 Agreement is required prior to the start of any organizing project.By signing I agree to Mindfully Minimized contract, terms of service, and indicate my certification of the Covid 19- Agreement.

In some circumstances, Mindfully Minimized LLC may request a deposit or a retainer before confirming appointments or providing services.
