WORK TRIAL & MUTUAL NON-DISCLOSURE AGREEMENT
This Work Trial Agreement (the "Agreement") is entered into and made effective as of the date of the final signature below (the "Effective Date"), by and between:
-
Mindfully Minimized LLC (operating high-end concierge services under Leah Morris, hereinafter referred to as the "Company", "we", "us", or "our"), and
-
The undersigned trial candidate (hereinafter referred to as the "Candidate", "you", or "your").
The Company and the Candidate may collectively be referred to as the "Parties" or individually as a "Party." The term "Client" refers to any customer or client of the Company's luxury home organizing and concierge sessions.
1. PURPOSE OF THE WORK TRIAL
We are thrilled to welcome you to experience our luxury concierge workflow. The purpose of this short-term work trial (the "Trial Project") is to provide a mutual evaluation period. It allows you to demonstrate your high-level skills, attention to detail, alignment with our luxury brand standards, and overall suitability for a permanent role as an Independent Contractor or Assistant with Mindfully Minimized LLC.
2. TRIAL TERMS & COMPENSATION CLAUSE
-
Independent Contractor Status: You acknowledge that participation in this Trial Project is strictly as an independent contractor. This engagement does not establish an ongoing employment relationship, employee benefits, or guarantee future contracts.
-
Two-Tier Compensation Structure:
-
First Session (Evaluation): The Candidate's very first work trial session is an introductory evaluation period and is unpaid. This session allows both parties to assess cultural and operational alignment. To ensure mutual fairness, this initial unpaid session is strictly capped at a maximum of 4 hours.
-
Subsequent Sessions (Active Trial): If invited back for any subsequent trial sessions, the Candidate will be compensated at a flat ad-hoc rate of $35.00 per hour for all active project time.
-
-
Invoicing & Payment: For paid sessions, compensation will be disbursed within 7 business days following the successful completion of the session and the receipt of a professional invoice from the Candidate.
-
Tax Responsibility: As an independent contractor, you are solely responsible for any federal, state, or local taxes resulting from this compensation. The Company will not withhold taxes from your payment.
-
Background and Licensing: By signing below, you strictly affirm that you have never been convicted of a felony, have never been incarcerated in connection with a felony, and currently hold a valid, un-suspended driver’s license.
3. ARRIVAL & PUNCTUALITY REQUIREMENTS
Luxury service relies on absolute precision and respect for the Client's schedule. The Candidate must adhere to the following arrival protocols:
-
Arrival Window: The Candidate is required to arrive at the designated client location exactly 10 to 15 minutes prior to the scheduled session start time. This allows for a brief morning alignment meeting and ensures the session begins exactly on schedule.
-
Delays: In the rare event of an unavoidable delay (e.g., severe traffic), the Candidate must notify Leah Morris immediately via phone call or direct text message at least 30 minutes before the scheduled arrival window.
-
Client Communication: The Candidate shall not contact the Client directly regarding scheduling, arrival times, or delays. All communication must flow through the Company.
4. LUXURY BRAND DRESS CODE & PRESENTATION
As a luxury home organization business, our team reflects the elevated environment of our high-end clientele. The Candidate agrees to adhere to the following grooming and uniform standards during all trial sessions:
-
Color Palette: Attire must strictly feature solid colors from the approved brand palette: Black, Pink, or Gray.
-
Attire Standards: Acceptable clothing includes unbranded, solid-colored professional activewear, tailored pants, or a conservative solid top. Clothing must be completely free of lint, stains, holes, graphic prints, or large athletic brand logos.
-
Footwear: Clean, indoor-only athletic shoes or supportive flats must be worn to ensure safety while moving items. Dirty outdoor shoes are strictly prohibited inside the Client's residence.
-
Grooming: Hair must be clean and neatly tied back or styled completely out of the face. Jewelry should be minimal and practical to avoid scratching luxury surfaces or personal property. Strong perfumes or synthetic colognes must not be worn out of respect for clients with environmental sensitivities.
5. CLIENT RELATIONSHIPS & PROCESS OWNERSHIP
-
The Client as Process Owner: In the luxury organizing space, the Client always maintains absolute ownership of the process. Mindfully Minimized LLC recognizes all items as the sole property of the Client. While you will elegantly guide and assist the purging and sorting process, the final decision on all items belongs exclusively to the Client.
-
Donations and Discards: The Company will determine the final destination of discarded items unless the Client requests a specific donation location at the time of service. You must verify with the Company prior to removing items if the Client requires a tax receipt from the donation center.
6. RESTRICTIVE COVENANTS & FIVE-YEAR NON-COMPETE
To protect the proprietary brand equity and high-net-worth relationships of Mindfully Minimized LLC, the Candidate agrees to the following restrictive covenants:
-
Non-Compete: The Candidate shall not directly or indirectly work with, consult for, solicit, or conduct any organizational or concierge business activity with any current, past, or prospective Clients of Mindfully Minimized LLC introduced during or prior to this trial.
-
Duration: This restrictive covenant shall remain in full force and effect for a period of five (5) years, commencing from the date of the Candidate's final day of work or trial project with Mindfully Minimized LLC.
-
Successors and Assigns: This agreement shall be binding upon and inure to the benefit of the Parties, their successors, permitted assigns, and personal representatives.
7. LUXURY CONFIDENTIALITY & PROPRIETARY INFORMATION
The high-end clientele of Mindfully Minimized LLC demands absolute discretion.
-
Absolute Privacy: All information seen, heard, or discussed during your trial—including the layout of the home, client identities, lifestyle habits, and financial or personal status—must be held in the strictest confidence.
-
Proprietary Protection: You acknowledge that you will have access to protected information relating to the Client's home, family, possessions, and vendor lists, as well as the Company’s creative frameworks, marketing strategies, and operational methodologies. You agree to preserve and protect this proprietary information in all physical and digital forms.
-
Third-Party Disclosure: You shall not disclose, disseminate, or exploit this confidential information for your own benefit or the benefit of any third party.
-
Media and Press Ban: You are strictly prohibited from discussing the Client, their home, or the Company's trial projects with any member of the press, media outlets, online blogs, or via public social media accounts, either directly or indirectly. This includes a strict ban on taking any "before and after" photographs or video footage on personal devices without explicit written consent from Leah Morris.
